1. INTRODUCTION

Your privacy and the security of your personal information are very important to us. This Privacy Policy describes how My Interview Practice, LLC, a limited liability company governed by the laws of State of New York, USA (the "Company," "we," “our,” or "us"), collects, stores, uses and discloses Personally Identifiable Information (defined below) from users of the Platform and/or Services, as those terms are defined in our Terms of Use, located at www.myinterviewpractice.com/terms-of-use (collectively, the “Services”).

By using the Services, you consent to our practices of collecting, storing, using, and disclosing your Personally Identifiable Information. If you are an individual using our Services, then "you," "your," or “yours” will refer and apply to you. If you are using our Services on behalf of an entity that you have been authorized to represent, "you," "your," or “yours” will refer and apply to that entity. If you do not agree with and consent to all the practices described in this Privacy Policy, please discontinue accessing and using the Services immediately.

Please bear in mind that this Privacy Policy applies only to information collected by the Company via the Services. We are not responsible for (i) the privacy of any information you reveal to other users when you share your Content with them, or (ii) the privacy practices of websites and applications that are operated or owned by third parties.

 

2. DEFINITIONS

All capitalized terms not defined in this Privacy Policy are defined in our Terms of Use.

Personally Identifiable Information. “Personally Identifiable Information” means any information that identifies or can be reasonably used to identify or contact a person if combined together with other pieces of information. Such Personally Identifiable Information may include, but is not limited to, a name, identification number, an online identifier, mailing or billing address, e-mail address, telephone number, photo, video, signature, Internet Protocol (“IP”) address location data, cookie identifier, date of birth, billing or credit/debit card information, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of a person.

Non-Personally Identifiable Information. “Non-Personally Identifiable Information” means information that cannot reasonably be used to identify or contact a person. Such Non-Personally Identifiable Information may include, but is not limited to, age, profession, gender, user’s browser type, browser version, operating system, files viewed, web pages visited, time and date of user’s visit, time spent on each webpage and other anonymous statistical data involving the use of the Services. 

 

3. WHAT INFORMATION IS COLLECTED, HOW IT IS USED AND WHEN IT IS SHARED

We collect both Personally Identifiable Information and Non-Personally Identifiable Information from you. Here is the description of information we collect about you, how and why we use it, and under what circumstances your information may be shared with others:

  • When you register for an Account, we will ask you to provide your full name and e-mail address. We collect this information for the purpose of providing you with the Services, identifying you as a user, sending you updates about our Terms of Use, Privacy Policy or other legal notices and marketing offers, or responding to your requests/inquiries.
     
  • When you record an interview video via the Platform, we will store this video for you on our servers solely for your convenience and for you to play it back at a later time. The Platform lets you share your videos with third parties or other users of the Platform. You assume all risks associated with sharing your videos, including any reliance by others on their accuracy, completeness or usefulness, or any disclosure that may make you or any third party personally identifiable or liable.
     
  • If you comment on a video of another user of the Platform, we will store your comment on our servers in order to make it available to such user, however, you shall solely assume all risks associated with any disclosure that may make you or any third party personally identifiable or liable.
     
  • If you provide us with any suggestions or feedback about the Platform and/or Services (“Suggestions”), you will automatically assign to us all rights to the Suggestions and agree that we shall have the right to use such Suggestions and related information in any manner we deem appropriate. We will treat any Suggestions you provide as non-confidential and non-proprietary. 
     
  • When you make a payment, PayPal processes your financial information. We employ PayPal, a third-party payment processing company, in order to facilitate the provision of the Services. When you make a purchase related to a premium membership, you are redirected to a secure PayPal page in order to make a payment. PayPal is solely responsible for processing and storing your financial data. If you wish to know how your financial data is processed and stored by PayPal, please read PayPal’s privacy policy. On our end, we are only able to see and store your billing address, e-mail address, and telephone number that will be used to contact you in case there is a billing issue.
     
  • Cookie Identifiers. “Cookies” are small files created by websites that a user visits. They are designed to hold a moderate amount of data specific to a particular user and website, and can be accessed either by a web server or a user’s computer or device. Cookies are a common and convenient way to carry information from one session on a website to another, or between sessions on related websites, without having to burden a server machine with massive amounts of data storage. Storing data on a server without using cookies has been determined by the technology industry to be potentially problematic due to the difficulty of retrieving a particular user's information without requiring a login on each visit to the website. If there is a large amount of information to store, then a cookie can simply be used as a means to identify a given user so that further related information can be looked up on a server-side database. For example, the first time a user visits a website, the user may choose a username, which is stored in the cookie, and then provide data such as password, name, address, preferred font size, and so on. This information would all be stored in a database using the username as a “key.” Subsequently when the website is revisited, the server will read the cookie to find the username, and then retrieve all of the user's information from the database without requiring the user to re-enter it.

    By using the Services, you agree that we may use cookies, to enable us to keep track of your movement from webpage to webpage so you are not asked to re-sign in or enter the same information you have already provided (during an active browser session). Such session cookies are destroyed when the current browser window is closed. If you refuse the use the cookies by changing the preferences in your browser, some features of the Services may not work or will be disabled. In order to ensure smooth operation of the Services, we advise you to accept the use of cookies.
     
  • Google Analytics. Third-party services such as Google Analytics are designed to help businesses and site owners analyze the traffic to their websites and mobile applications by collecting, monitoring and analyzing Non-Personally Identifiable Information. 

    Google Analytics works via a “page tag” or so-called “Google Analytics Tracking Code,” which is a snippet of JavaScript code. A website owner adds this code to every page of a website that they would like to track. When a website user visits the website (if Javascript is enabled), the tracking code runs in such user’s browser, collects the user’s data, and sends it to a Google data collection server. Google Analytics may collect the following types of Non-Personally Identifiable Information about how users use a website: date and time of visit, webpages visited, time spent on each webpage, referring website details (such as the URI a user came through to arrive at this site), type of web browser, type of operating system, Flash version, screen resolution, screen color processing ability, network location and IP address (IP address may be both Personally Identifiable Information and Non-Personally Identifiable Information depending on whether it is anonymized or not). Google Analytics may also be used to track such Non-Personally Identifiable Information as: the number of document downloads, clicks on links leading to external web sites, errors when users fill out forms, clicks on videos, scroll depth, interactions with site-specific widgets. As stated by Google, the prevailing amount of information collected through the Services (and other websites) is Non-Personally Identifiable Information.

    By using the Platform, you agree that we may use third-party services such as Google Analytics to help us analyze the traffic connected with our Services.   • Facebook’s Remarketing Service. We use the remarketing service Pixel, part of Facebook, a third party, to show advertisements (also called interest-based advertising) to you on third-party websites after you have visited the Platform. You can learn more about interest-based advertising from Facebook by visiting www.facebook.com/help/164968693837950. As stated by Facebook, Facebook adheres to the Self-Regulatory Principles for Online Behavioral Advertising established by the Digital Advertising Alliance (“DAA”).   • E-mail Marketing. We and a third-party e-mail marketing service provider MailChimp may use your name, e-mail address, and professions you are interested in to contact you with newsletters, marketing or promotional materials, and other similar information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us or  third parties by following the unsubscribe links or instructions provided in any e-mails we or third parties send.   • Business Transfers or Bankruptcy. We may transfer or otherwise share some or all of our assets, including your Personally Identifiable Information, in connection with a merger, acquisition, reorganization or court-ordered distribution of assets in the event of bankruptcy.
     
  • Disclosures for Legal Purposes. We may disclose your Personally Identifiable Information if required to do so by law or in the good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect and defend our rights or property or the rights or property of others if deemed necessary in our sole discretion; (iii) act in urgent circumstances to protect the personal safety of Services users or the public; or (iv) protect us from legal liability.
     
  • Use and Disclosure of Non-Personally Identifiable Information. We reserve the right to use and disclose Non-Personally Identifiable Information for any purpose and to share it with any third party at our sole discretion.

 

4. LINKS TO THIRD-PARTY WEBSITES

The Services may contain advertisements with links to third-party websites. The fact that our Services may contain links to third-party websites shall not be construed as an endorsement, authorization or representation of our affiliation with those third parties. We do not exercise control over third-party websites. These other websites may place their own cookies or other files on your computer, collect data, or solicit Personally Identifiable Information from you. We encourage you to read the privacy policies or statements of the other websites you visit.       

                                                                                             

5. SECURITY

The security of your information is important to us. We use the latest commercially-reasonable efforts to store and maintain your information in a secure environment. We have implemented and continue to update these and other commercially-reasonable procedures designed to limit unauthorized access, use or disclosure of your information. We follow strict password requirements and OWASP guidelines for secure coding.

You are also responsible for helping us protect the security of your Personally Identifiable Information. For instance, never give out your password, and remember to log out of your Account when you are finished using the Services.

Notwithstanding our efforts, no security is entirely impenetrable, and to that end, we disclaim any liability in connection with a breach of our security.

6. LOCATION OF SERVERS

If you access the Services outside the United States, please note that we will store any information about you referenced in this Privacy Policy, including your Content, on dedicated servers hosted by HostGator.com, LLC and that those servers are located in the United States.

 

7. YOUR RIGHTS WITH REGARD TO INFORMATION WE COLLECT ABOUT YOU

You have the following rights with regard to information about you:

  • the right to be informed about what kind of information about you is collected, stored, processed and disclosed by us; therefore, we have compiled this Privacy Policy for you;
  • the right of access (you can request us to provide you verbally or in writing with the type of information we store about you and we have a month to respond to your request);
  • the right to rectify any Personally Identifiable Information that is inaccurate;
  • the right to erasure (some conditions apply, see Data Retention Section, below);
  • the right to restrict processing your Personally Identifiable Information, however, if you restrict us from processing a part of your Personally Identifiable Information that is essential to our provision of the Services, you may be asked to terminate your Account and stop using the Services;
  • the right to data portability, which allows users of the Services to obtain and reuse their Personally Identifiable Information for their own purposes across other services; you may request us to transmit your Personally Identifiable Information directly from our servers to another company’s servers and we will do so, where technically feasible;
  • the right to object (for example, you have an absolute right to stop us from using your Personally Identifiable Information for direct marketing -  read our opt-out instructions below); you may express your objection verbally or in writing and we have a month to respond to any such objection; we may still continue processing your Personally Identifiable Information if we are able to show that we have a compelling reason for doing so;
  • the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or that affects you significantly.

8. DATA RETENTION

Your Personally Identifiable Information will be erased when: (i) it is no longer needed for its original purpose; (ii) you withdraw your consent for us to store your information by deleting your Account; (iii) there is no justified reason for the processing of your Personally Identifiable Information and you object to our processing of your Personally Identifiable Information; or (iv) erasure of your Personally Identifiable Information is required in order to fulfil a statutory obligation under EU, U.S., or state law. Under any of the above-mentioned circumstances, we will make sure your Personally Identifiable Information is erased. You may request us to erase your Personally Identifiable Information verbally or in writing and we have a month to respond to any such request.

 

9. MINORS POLICY

The age of majority varies by jurisdiction and circumstances, but it is predominantly established as eighteen (18) years of age. Minors under the legal age of majority in their jurisdiction may use the Services, however, a minor’s parent or legal guardian is required to register for an Account and authorize the minor’s use of same.

No one under the age of 18 may provide any Personally Identifiable Information to the Company via the Services. In the event that we learn that we have collected Personally Identifiable Information from an individual under the age of 18 without prior parental consent, we will delete that information as quickly as practicable. 10. COMPLIANCE WITH LAWS

Our Privacy Policy complies with the strictest laws on handling of Personally Identifiable Information. Such laws include: the USA’s Children's Online Privacy Protection Act (COPPA), the European Union’s General Data Protection Regulation (GDPR), and the California Consumer Privacy Act.

 

11. CHANGES TO PRIVACY POLICY

We may amend this Privacy Policy from time to time. We will post any changes to this Privacy Policy here and change the Last Revised date at top of this Privacy Policy page so that you will always know what information we gather, how we might use that information, and whether we will disclose that information to anyone. You are required to periodically check this page for updates.

Your continued use the Services following any such modifications will constitute your consent to all the practices described in the updated Privacy Policy. If you do not agree to the updated Privacy Policy, please terminate your Account and stop using the Services.

 

12. ENTIRE AGREEMENT

This Privacy Policy , our Terms of Use, and any additional or supplemental policies noticed to you from time to time constitute the entire agreement between you and us with respect to the subject matter covered herein and supersede all prior discussions and agreements between you and us with respect to such subject matter, whether verbal or written.

 

13. OPT-OUT OF RECEIVING MARKETING MATERIALS

When you receive newsletters, surveys, offers, and other promotional materials from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe link provided in the e-mail you receive or by contacting us directly at admin@myinterviewpractice.com. Despite your indicated e-mail preferences, we may send you service-related communications, including notices of any updates to our Terms of Use or Privacy Policy.
